REACTUS

MSWiA Licence — comprehensive support in obtaining and extending your licence

In Poland, a licence issued by the Ministry of the Interior and Administration (MSWiA) is a prerequisite for lawfully conducting business in the trading and manufacturing of weapons, ammunition, explosives and products and technology intended for military or police use. REACTUS guides companies through the entire licensing process — from the initial assessment to the licensing decision, and beyond, for as long as the licence remains in force.

Who needs an MSWiA licence

The licensing obligation arises from the Act of 13 June 2019 on conducting business activity in the field of manufacturing and trading in explosives, weapons, ammunition and products and technology intended for military or police use (consolidated text: Journal of Laws 2023, item 1743).

A licence is a government authorisation for business activity that carries particular significance for the security of the state or its citizens, or for an important public interest. On that basis, Polish law requires every entity involved in manufacturing or trading explosives, weapons, ammunition and products and technology intended for military or police use to hold the appropriate licence. This applies in particular to:

  • —
manufacturers and distributors of weapons and ammunition,
  • —
companies trading in products intended for military or police use,
  • —
providers of gunsmithing and servicing work,
  • —
businesses operating within defence industry supply chains.

How we support you

  • /001
Coordinating the professional training required for the individuals named in the licence.
  • /002
Drawing up a realistic action plan with milestones for the licensing process.
  • /003
Preparing the complete set of documents and submissions to MSWiA — the licence application together with all annexes.
  • /004
Managing records relating to licensed infrastructure — adapting facilities to the authority's requirements.
  • /005
Advising on licensed-activity records — maintaining the registers and documentation required by law.
  • /006
    Drafting the licensing documents:
    • facility classification card,
    • instructions for protecting the site and its buildings,
    • emergency response plan.

Extending an existing licence

We also support companies that already hold a licence and plan to extend the scope of their activity — to new categories of products, to manufacturing alongside trading, or to additional locations. We prepare the amendment so that it does not disrupt the company's day-to-day operations.

How we work together

  • /001
Initial audit — assessing whether the company and the individuals involved meet the statutory requirements.
  • /002
Schedule — an action plan with clearly assigned responsibilities.
  • /003
Documentation and infrastructure — preparing the application and adapting the facilities.
  • /004
Proceedings — support in dealings with the licensing authority until the decision is issued.
  • /005
Post-licensing care — records, inspections and licence amendments.
